Kenya's President to know fate of ICC case

Kenya's President His Excellency Hon. Uhuru Kenyatta and the entire Kenyan Citizens have for a while been waiting to know the fate of their leader concerning the ICC cases.For almost two years now, the office of the prosecutor had unsuccessfully applied for access to president Uhuru Kenyatta’s bank accounts. Chief prosecutor Fatou Bensouda argued the accounts would provide evidence on whether Uhuru funded retaliatory attacks in Naivasha and Nakuru during the 2007/2008 post election violence has earlier stated in the cases presented before the ICC. On his part, attorney general Githu Muigai insisted only a Kenyan court could grant such access and not any other party can have that permission to access the accounts, this however brought some little bit of concern as to why the Kenyan Government did not allow the access to the bank accounts and earlier transactions undertaken by the accounts to be tracked. Bensouda said the government was not co-operating.





Early this year, Bensouda convinced judges at the trial chamber v (b) to compel the government to disclose the records. She said without access to Uhuru’s financial records, and without other new evidence, the prosecution will be required to withdraw charges on crimes against humanity facing Uhuru. Since last week, the office of the prosecutor has been going through the bundle of records to determine whether they meet the threshold or more would be needed. That will be the subject of debate during the status conference that is to be held soon enough to decide on the case.
